1. Seller
These general terms of sale govern the purchase of the paid subscription of bernal-fintech.com, sold by Bernal FinTech SL, with registered address at Calle José Francisco Pérez Sánchez 20, 30120 El Palmar (Murcia), España, tax ID B56268253 and registry details Registro Mercantil de Murcia, tomo 3649, folio 13, hoja MU-111260, inscripción 1ª. Contact: contact@bernal-fintech.com, telephone +34 722 74 79 52.
2. Subject of the contract
The contract covers the paid subscription to bernal-fintech.com. It is offered in three plans — Platform (access to the analysis platform), Cafinvest (the weekly live training sessions) and Pack (both) —, each with a monthly or an annual billing cycle, and for three customer types: Individual, Individual Pro and Company. What each plan includes, and its price for each billing cycle and customer type, are described on the subscription page at the time of purchase. The subscription is a digital service supplied online; no physical goods are delivered. Whatever the customer type, each subscription gives access to one named user account.
3. Prices and payment
The price of each plan, billing cycle and customer type is shown on the subscription page, and the total amount, with the applicable taxes, is shown again on the payment page before you pay. All prices are in euros (EUR); if you pay with a card in another currency, your bank may apply its own exchange rate and fees. For the Individual and Individual Pro types, the price shown is the final price and includes VAT where it applies. For the Company type, the price shown does not include VAT: the payment page calculates the applicable tax from your billing address and your tax identification number and adds it to the price; if your business is established in another Member State of the European Union and you give a valid VAT number, no VAT is charged and the reverse charge applies, so you account for the VAT in your country. If your business is established outside the European Union, no Spanish VAT is charged; any tax that may apply in your country is not included and is your responsibility. For the Company type, the payment page asks for the tax identification number of your business and requires it where it supports that number for the country of your billing address.
Payment is charged in advance for each billing cycle, with the payment methods shown on the payment page. That page is hosted and operated by our payment processor, Stripe (Stripe Payments Europe, Limited, Ireland): your card or other payment details are entered there, never reach our website and are never seen or stored by us.
To subscribe, choose the plan, the billing cycle and the customer type on the subscription page and press the subscribe button: you are taken to the payment page, where you enter your details, check the price and the taxes, choose how you want to receive the invoice, tick the box by which you accept these terms and confirm the subscription. Until you confirm it, you can correct your details or go back to the subscription page without any commitment.
4. Duration, renewal and cancellation
The subscription runs for the billing cycle chosen (monthly or annual) and renews automatically at the end of each cycle at the same price, unless we have notified you of a change as described below, and we will send you a reminder by e-mail before each renewal: at least 30 days before an annual renewal and 15 days before a monthly one. There is no minimum commitment: you can cancel at any time from "Manage subscription" on your account page or, without signing in, with the "Cancel your contract here" function at the bottom of every page; the cancellation takes effect at the end of the cycle already paid, and you keep access until then. No partial refund is due for the unused remainder of a cycle, except where mandatory law provides otherwise or you exercise the right of withdrawal.
If the price or the material conditions of the subscription change, we will notify you by e-mail at least 30 days in advance and you may cancel before the renewal at no cost.
Termination for breach: account sharing is prohibited by the terms of use, which allow a single active session per account. If sharing is detected we will notify you, and a second detection entitles the seller to terminate the contract and delete the account. In that case the current billing period will not be refunded; on annual plans, the unused proportional part will be refunded.
5. Right of withdrawal
If you are a consumer, you have 14 calendar days from the day the contract is concluded (the day you subscribe) to withdraw from it without giving any reason. To withdraw, inform us of your decision by an unequivocal statement sent to contact@bernal-fintech.com before that period ends; you may use the model form below, but it is not obligatory. You can also withdraw online with the "Withdraw from contract here" function at the bottom of every page; we will acknowledge receipt by e-mail at once.
Immediate start: the subscription gives access as soon as it is concluded. That is why the box you tick on the payment page to accept these terms also contains your express request that the service begin immediately, before the withdrawal period ends, and your acknowledgement that you will lose the right of withdrawal once the service has been fully supplied (Article 98(8) of the consolidated text of the Spanish General Law for the Defence of Consumers and Users).
If you withdraw, we will refund all payments received from you without undue delay and in any case within 14 calendar days of the day we are informed of your decision, using the same means of payment you used, unless you expressly agree otherwise, and at no cost to you (Article 107). From that refund we will deduct the amount proportional to the part of the service supplied until you informed us of your withdrawal, in relation to the total price agreed (Article 108(4)). Once the service has been fully supplied, the right of withdrawal is lost (Article 103(a)).

6. Legal guarantee of conformity
The digital service must conform to what was offered at the time of purchase. If it does not, you are entitled to have it brought into conformity and, where that is impossible or is not done within a reasonable time, to a proportionate price reduction or to the termination of the contract, under Articles 114 and following of the consolidated text of the Spanish General Law for the Defence of Consumers and Users (in particular Articles 117 to 119 ter). We will supply the updates needed to keep the service in conformity for the duration of the contract.
7. Contract languages and archiving
The contract may be formalised in Spanish, English, German or French. Your subscription is recorded in your account on this site, and your acceptance of these terms is recorded with the payment at our payment processor. When you subscribe we send you these terms and the confirmation of the contract, with the date of your acceptance, by e-mail, and we keep every version of these terms with its date. You can request a copy of the version you accepted at any time at contact@bernal-fintech.com.
8. Payment confirmation and invoice
When you subscribe, the confirmation e-mail we send you includes the details of your subscription, these terms of sale and the confirmation of your express request that the service start immediately. After each payment —the first one and each renewal— our payment processor, Stripe, sends you a confirmation of the payment (receipt) by e-mail. The invoice is issued by Bernal FinTech SL, not by Stripe, in the format you choose on the payment page: electronic (PDF by e-mail) or on paper, by post; you can change that choice at any time, at no cost, by writing to contact@bernal-fintech.com.
9. Complaints and consumer dispute resolution
For any complaint about your subscription, write to contact@bernal-fintech.com, use the contact form on this site, or write to our postal address, Calle José Francisco Pérez Sánchez 20, 30120 El Palmar (Murcia), España, or call +34 722 74 79 52. We will acknowledge receipt, give your complaint a reference number and answer it as soon as possible and in any case within 15 days of receiving it (Article 21 of the consolidated text of the Spanish General Law for the Defence of Consumers and Users). We are not a member of, and do not participate in, any alternative dispute resolution scheme for consumers.
10. Governing law and jurisdiction
These terms of sale are governed by Spanish law. Any dispute shall be submitted to the courts of Murcia (Spain), except where consumer protection law provides a different mandatory forum. If you are a consumer, you keep the protection of the mandatory rules of the country where you have your habitual residence and, where those rules or the applicable international conventions so provide, you may bring your claim before the courts of that country; within the European Union this follows from Regulation (EU) No 1215/2012 and Regulation (EC) No 593/2008.
Bernal FinTech SL sells this service from Spain. Contracts with business customers are concluded in Spain. If you access the site from another jurisdiction, you do so on your own initiative and at your own risk; that access does not subject Bernal FinTech SL to the laws or courts of that jurisdiction, except for the mandatory rules referred to above.
